During my research for our website it became obvious that the one document that brings us all together as property owners in the Lake Almanor Pines Units 1 and 2 Subdivision is our CC&R’s (“Covenants, Conditions & Restrictions”. Since membership in “Lake Almanor Pines Units 1 and 2 Property Owners Association is voluntary, the Articles of Incorporation and By-Laws only pertain to the members of the association.
This week I spent some time walking the neighborhood and chatting with a few of the new residents and I was shocked when they were unaware of the CC&R’s and even the Property Owners Association. In fact one person said they asked the realtor specifically if there was any CC&R’s and she said “no”. When I got home I checked my Title Insurance and there it was under Schedule B, Part II, section 4. “Covenants, Conditions and Restrictions” Recorded July 2, 1965. Book 170, Page 232, of Official Records. The copy I have of the CC&R’s is entitled “Declaration of protective convents and restrictions for Lake Almanor Pines Subdivision Unit No. One”. What about Unit Two? My next call was to the title company and I asked for a copy of the CC&R’s attached to properties in unit two. The copy I received was identical to my (unit one) copy except the title has Unit one replaced with Unit two. See below.
So there we have it. The one document we all have in common. My next post will cover the CC&R’s and what parts affect each and everyone of us and the importance of the Property Owners Association.
